Who qualifies as a caregiver under Medicaid rules?
Client Eligibility
To qualify for the SFC program under Ohio’s PASSPORT Waiver, the client must:
- Be at least 60 years old.
- Meet PASSPORT Medicaid waiver eligibility requirements.
- Require a nursing home level of care.
- Live in a private residence with their caregiver.
- Have a care plan approved by a licensed physician, physician assistant, or nurse practitioner.
- Agree to receive daily non-medical care and supervision from the caregiver.
Caregiver Eligibility
- To serve as a caregiver under Ohio’s Structured Family Caregiving program, the caregiver must:
- Must be 18 years of age.
- Live in the same home as the client.
- Pass all required state and federal background checks.
- Be a family member or friend, but not a Spouse or a Legal guardian
- Be able to provide daily non-medical support and 24-hour oversight.
Special Provisions for Spouses
Ohio has specific rules regarding spouses and individuals with legal decision-making authority.
Under Rule 5160-44-32 of the Ohio Administrative Code, spouses and certain relatives may only provide Structured Family Caregiving if they meet all criteria outlined in this regulation.
If a spouse is interested in providing SFC services, the agency will review their situation to determine if they meet the state-approved exceptions.
What are ADLs?
Caregivers are compensated for helping with activities for daily living (ADLs). They include:
- Feeding
- Bathing/Personal Hygiene
- Dressing
- Using the Toilet
- Ambulating
- Transportation
